Welcome to PEPE Cannabis Store. These Terms & Conditions ("Terms") govern your access to and use of the website located at pepecannabisstore.com (the "Website") and any purchases made through our online store, operated by PEPE Cannabis Store ("PEPE," "we," "us," or "our"). PEPE Cannabis Store is an authorized cannabis retailer licensed by the Alcohol and Gaming Commission of Ontario (AGCO), operating retail locations in Burlington and St. Catharines, Ontario.

By accessing or using this Website, or by placing an order through our online store, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use this Website.

1. Age Restriction & Verification

You must be 19 years of age or older to access this Website, create an account, or purchase cannabis products in Ontario.

By using this Website, you confirm that you are at least 19 years of age. We reserve the right to request proof of age at any time. Valid government-issued photo identification (such as a driver's licence, passport, or Ontario photo card) is required at the time of pickup for all orders, regardless of the customer's apparent age. If valid identification cannot be provided, or if the person receiving the order appears to be intoxicated, the order will not be released and may be subject to cancellation.

It is a criminal offence to purchase cannabis on behalf of, or to provide cannabis to, anyone under the age of 19.

2. Legal Compliance

PEPE Cannabis Store operates in compliance with the Cannabis Act (Canada), the Cannabis Licence Act, 2018 (Ontario), the Cannabis Control Act, 2017 (Ontario), and all applicable regulations and AGCO requirements. All cannabis products sold by PEPE are sourced exclusively from the Ontario Cannabis Store (OCS), the province's authorized wholesaler.

Cannabis products purchased from PEPE are for personal use only and may not be resold or distributed. You are responsible for complying with all laws applicable to the possession, transportation, and consumption of cannabis in Ontario, including public possession limits (currently 30 grams of dried cannabis or its equivalent) and restrictions on where cannabis may be consumed.

Cannabis products may not be taken across international borders. It is illegal to transport cannabis outside of Canada.

3. Online Ordering & Payment

Orders may be placed through our online menu for pickup at our Burlington or St. Catharines locations. When you place an order, you are making an offer to purchase the selected products, which we may accept or decline at our discretion.

Payment. We accept online payment through our authorized payment provider at the time of checkout, as well as accepted payment methods in store. By submitting payment information, you represent that you are authorized to use the payment method provided. All prices are listed in Canadian dollars (CAD) and are subject to applicable taxes, which will be calculated at checkout.

Order acceptance. All orders are subject to product availability and verification. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing or listing errors, unavailability of product, or failure to meet age verification requirements. If your order is cancelled after payment has been processed, you will receive a full refund to your original payment method.

Pricing errors. While we make every effort to ensure accurate pricing and product information, errors may occur. In the event of a pricing error, we reserve the right to cancel the affected order and issue a full refund.

4. Pickup

Orders placed for pickup must be collected by the person who placed the order, during regular store hours, at the location selected at checkout. Valid government-issued photo ID matching the name on the order is required. Orders not picked up within forty-eight (48) hours may be cancelled and refunded to the original payment method.

5. Returns & Refunds

In accordance with applicable regulations and for health and safety reasons, all sales of cannabis products are final. We cannot accept returns or exchanges of cannabis products once they have left the store, except in the case of defective products.

Defective products. If you believe a product is defective (for example, a faulty vape cartridge or damaged packaging seal), please contact the store where the purchase was made within a reasonable time, with your receipt or order confirmation and the product in its original packaging. Defective products may be exchanged or refunded at our discretion and in accordance with our Refund Policy and applicable regulations.

Cancelled orders. Orders cancelled before pickup will be refunded in full to the original payment method. Refund processing times vary by payment provider and financial institution, typically 3–10 business days.

6. Product Information

Product descriptions, images, THC/CBD content, and other information displayed on this Website are provided by licensed producers and the OCS, and are for general information only. Actual product characteristics, including cannabinoid content, may vary between lots. We do not guarantee the accuracy or completeness of product information and recommend reviewing the product label before consumption.

Nothing on this Website constitutes medical advice. Cannabis products sold by PEPE are recreational products and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Consult a healthcare professional before using cannabis, particularly if you are pregnant, breastfeeding, taking medication, or have a medical condition.

7. Health & Safety

Cannabis can impair concentration, coordination, and judgment. Do not drive or operate machinery after using cannabis. Cannabis use carries health risks, particularly for young people, and may be habit-forming. Keep all cannabis products out of the reach of children and pets.

8. Accounts & Loyalty Program

If you create an account or join Pepe's Club, you are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate and current information. We reserve the right to suspend or terminate accounts that violate these Terms or applicable law. Loyalty program benefits have no cash value, are non-transferable, and may be modified or discontinued at any time.

9. Intellectual Property

All content on this Website — including the PEPE name, logo, graphics, text, images, and design — is the property of PEPE Cannabis Store or its licensors and is protected by Canadian and international intellectual property laws. You may not reproduce, distribute, or use any content from this Website without our prior written consent.

10. Prohibited Use

You agree not to use this Website: (a) if you are under 19 years of age; (b) for any unlawful purpose, including the resale or distribution of cannabis; (c) to provide false or misleading information, including false age or identity information; (d) to interfere with the security or operation of the Website; or (e) in any manner that violates the Cannabis Act, Ontario cannabis legislation, or any other applicable law.

11. Privacy

Your use of this Website is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. Personal information collected for age verification and order fulfillment is handled in accordance with applicable privacy laws.

12. Limitation of Liability

To the maximum extent permitted by law, PEPE Cannabis Store, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Website or the purchase or use of any products, including damages resulting from the consumption of cannabis. Our total liability for any claim arising from a purchase shall not exceed the amount paid for the product(s) giving rise to the claim. Nothing in these Terms limits any rights you may have under applicable consumer protection legislation that cannot be waived.

13. Indemnification

You agree to indemnify and hold harmless PEPE Cannabis Store and its owners, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these Terms, your violation of any law, or your misuse of this Website or any products purchased from us.

14. Third-Party Services

Our online menu and checkout may be powered by third-party platforms (including Dutchie) and payment processors. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for the content, availability, or practices of third-party websites or services linked from this Website.

15. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top of this page indicates when these Terms were most recently revised. Your continued use of the Website after changes are posted constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of this Website shall be subject to the exclusive jurisdiction of the courts of Ontario.
